General Business Terms and Conditions
(AGBs - Allgemeine Geschäftsbedingungen)
The "Unternehmungsgruppe Dr.Berer” (Dr. Berer Consortium) consisting of the “Salzburger Festungskonzerte GmbH (Salzburg Fortress Concerts – a limited liability partnership, the Salzburg Stadt-Schiff-Fahrt GmbH & Co KG (Salzburg City Boat Cruises – a limited liability and limited commercial partnership company), Dr. Berer KEG (Dr. Berer limited acquisition partnership), and Dr. Erich Berer – hereafter known as the “licensee”, sets forth the following Business Terms and Conditions as his legal foundation for all the business transactions that involve Internet bookings.
Ticket Cancellations and Liabilities
A cancellation of prepaid Tickets is not possible unless compelling circumstances, as set forth in the KSchG (Cancellation Protection Law), exist. An explicit referral is made to the Consumers right for withdrawal, which must be asserted within 7 business days after taking delivery of the goods or the finalization of the contract. In case of a Consumer withdrawal, in accordance with the provisions of the KSchG (Cancellation Protection Law), the Consumer agrees to pay the return shipping charges. It is also pointed out that tickets will be taken back on a cost minus commission basis only, 20% of the original purchase price will be deducted for commission fees. The “licensee” is only the sales agent for the ticket(s) and is not liable for the reimbursement of the admission charges when a cancellation occurs, but an attempt will be made to get a refund from the event organizer on the consumers behalf.
Consumers are not entitled to the reimbursement of Hotel accommodation expenses, Travel expenses, etc. that may be incurred. Program changes, Cast changes, as well as venue Starting Time changes do not justify a refund or a possible price reduction. The Consumer is not entitled to the reimbursement of additional expenses or expenditures such as Hotel accommodation expenses or Travel expenses that may be incurred.
Within the scope of the Boat-Cruises that we offer, we would like to point out that during high or low water conditions on the river, no boat cruises will take place. The ticket(s) will remain valid or can be returned for a full refund of the original purchase price as stated on the ticket(s). No liability will be accepted for additional expenses or expenditures incurred by the Consumer.
Stonierung von Hotelreservierungen:
Bis 10 Wochen vor Anreise fallen keine Stornokosten an. Bei späteren Stornos fallen die gesamten Hotelnächtigungskosten an, sofern nicht zwingende Bestimmungen des KSchG anzuwenden sind. Ausdrücklich hingewiesen wird auf das dem Konsumenten zustehende Rücktrittsrecht, welches binnen 7 Werktagen ab Abschluss des Vertrages geltend zu machen ist.
Preise und Zahlungsmodaliäten:
Es gelten die im Angebot angeführten Preise wobei festgehalten wird, daß Preisänderungen vorbehalten sind. Zahlungen sind prompt bei Bestellung bzw. nach Rechnungserhalt ohne Abzug fällig. Die bei einer Banküberweisung entstehenden Zusatzkosten bzw. sonstigen Spesen gehen zu Lasten des Käufers und sind dem Verkäufer zu ersetzen.
Versandkosten:
Für Postaufwand werden € 7,00 (Ausland) bzw. € 5,00 Inland verrechnet.
Sonstiges:
Nebenabreden bedürfen zu ihrer Gültigkeit der Schriftform.
